Privacy Policy

Last updated: August 2, 2026

FairFlow LLC ("FairFlow," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you visit our website (myfairflow.com) or use our services.

By using our website or services, you consent to the practices described in this Privacy Policy. If you do not agree with this policy, please do not access or use our services.

1. Information We Collect

We collect information that you provide to us directly and information that is collected automatically when you use our website.

1.1 Information You Provide

When you interact with our website, purchase a license, or subscribe to a trial, we may collect the following information:

  • Contact Information: Name, email address, phone number, mailing address
  • Account Information: Username, password (encrypted), account preferences
  • Payment Information: Credit card details, billing address (processed securely by Stripe, our third-party payment processor). Stripe collects and processes payment card data on our behalf in a PCI DSS compliant environment. FairFlow does not store your full credit card number
  • Subscription Information: Trial subscription status, selected product (Safety First, Performance, or Custom AI Development), subscription start and end dates
  • License Information: Rithmic access data, trading account details necessary for software provisioning
  • Communications: Information you provide when you contact us via email, support tickets, or forms
  • Marketing Preferences: Your choices regarding receiving promotional communications

1.2 Automatically Collected Information

We do not run analytics, advertising, or tracking software on this website. There is no Google Analytics, no advertising pixel, and no third-party tracking script. We do not build visitor profiles and we do not track you across other websites.

The only information collected automatically is what our hosting provider records in order to serve the site securely:

  • Server Logs: IP address, requested URL, timestamp, browser user-agent and referring page, recorded by our hosting provider (Vercel) for delivery, security, and abuse prevention. These logs are retained for a limited period and are not used to identify you or to build a marketing profile

Our lawful basis for this limited processing is our legitimate interest in operating a secure and functioning website (GDPR Art. 6(1)(f)).

2. How We Use Your Information

3. Information Sharing and Disclosure

We do not sell, rent, or trade your personal information. We share your information only in the following circumstances:

3.1 Service Providers

We share information with trusted third-party service providers who assist us in operating our business:

  • Stripe: Payment processing for license fees and trial subscriptions (USD 100 trial fee). Stripe handles all payment card data using PCI DSS compliant infrastructure. For more information, see Stripe's Privacy Policy
  • Vercel: Website hosting and content delivery. Processes server request logs as described in Section 1.2
  • Workflow automation (n8n): When you submit a form on this website, the details you enter (name, email address, and the product you selected) are transmitted to our workflow automation system at automation.evercompany.eu, where they are stored so we can respond to your enquiry and manage follow-up communication
  • Email delivery provider: Sending transactional and, where you have consented, marketing email

These service providers act as processors on our behalf. They are bound by data processing agreements, may use your information only for the purposes we specify, and may not use it for their own purposes.

Changes to our processors. We maintain the list above as an accurate record of the processors who handle personal data on our behalf. If we add or replace a processor in a way that materially affects how your personal data is handled, we will update this page and revise the "Last Updated" date. Where the change requires your consent, we will ask for it before the new processor begins handling your data.

3.2 Legal Requirements

We may disclose your information if required to do so by law or in response to:

  • Valid legal processes (subpoenas, court orders, warrants)
  • Requests from government authorities or regulatory bodies
  • Protection of our legal rights or property
  • Investigation of potential violations of our Terms of Service
  • Emergency situations involving danger of death or serious physical injury

3.3 Business Transfers

In the event of a merger, acquisition, bankruptcy, or sale of assets, your information may be transferred to the acquiring entity. We will notify you of any such change and any choices you may have.

3.4 With Your Consent

We may share your information with third parties when you explicitly consent to such sharing.

3.5 No Selling of Data

We do NOT sell your personal information to third parties for their marketing purposes.

4. Data Security

We implement industry-standard security measures to protect your personal information from unauthorized access, disclosure, alteration, and destruction.

4.1 Security Measures

  • Encryption: SSL/TLS encryption for data transmission between your browser and our servers
  • Payment Security: Stripe handles all payment card data using PCI DSS compliant infrastructure
  • Access Controls: Access to personal information is limited to the people who need it to do their work, and is protected by individual accounts and multi-factor authentication
  • Storage: Personal data is held on managed infrastructure operated by the providers listed in Section 3.1, which encrypt data at rest
  • Data Minimisation: We collect only what we need. We do not run analytics or tracking, so there is no behavioural profile to lose
  • Review: We review our security arrangements and our list of processors periodically, and whenever we change how personal data is handled

4.2 No Absolute Security

While we strive to protect your information, no method of transmission or storage is 100% secure. We cannot guarantee absolute security of your data. You are responsible for maintaining the confidentiality of your account credentials.

4.3 Data Breach Notification

In the event of a data breach that affects your personal information, we will notify you promptly in accordance with applicable laws and take reasonable steps to mitigate any harm.

5. Your Rights

Depending on your location, you may have certain rights regarding your personal information.

5.1 General Rights

  • Access: Request access to the personal information we hold about you
  • Correction: Request correction of inaccurate or incomplete information
  • Deletion: Request deletion of your personal information (subject to legal retention requirements)
  • Opt-Out: Unsubscribe from marketing communications at any time
  • Data Portability: Request a copy of your data in a structured, machine-readable format

5.2 GDPR Rights (EU Users)

If you are located in the European Union, you have additional rights under the General Data Protection Regulation (GDPR):

  • Right to object to processing of your personal data
  • Right to restrict processing in certain circumstances
  • Right to lodge a complaint with a supervisory authority
  • Right to withdraw consent where processing is based on consent

5.3 CCPA Rights (California Users)

If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA):

  • Right to know what personal information we collect, use, and disclose
  • Right to request deletion of personal information (with exceptions)
  • Right to opt-out of the sale of personal information (we do not sell your data)

5.4 Exercising Your Rights

To exercise any of these rights, please contact us at hello@myfairflow.com. We will respond to your request within the time period required by applicable law.

6. Cookies and Tracking Technologies

This website does not use cookies. We set no cookies of our own, and we load no third-party script that sets them. There is no analytics cookie, no advertising cookie, and no cross-site tracking. This is also why you are not asked to dismiss a cookie banner: there is nothing to consent to.

6.1 What This Means

  • We do not store any data on your device when you browse this site
  • We cannot recognise you when you return, and we do not attempt to
  • We do not share browsing behaviour with advertising networks
  • You do not need to change any browser setting to browse this site privately

6.2 Third-Party Content

Some pages embed a scheduling calendar provided by Cal.com (served from app.cal.eu, hosted in the European Union) so you can book a call with us. This content is loaded only on pages where a booking option is offered, and only when you scroll to it or open it. When it loads, Cal.com receives your IP address and may set cookies within its own frame in order to operate the booking tool. If you book a call, the details you enter are processed by Cal.com so that the appointment can be created. See the Cal.com Privacy Policy. If you would rather not use the embedded calendar, you can arrange a call by emailing us instead.

6.3 Do Not Track

Because we do not track visitors in the first place, "Do Not Track" browser signals require no special handling on our side.

7. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required by law.

7.1 Retention Periods

  • License Data: Retained for the duration of your license plus 7 years for legal and accounting compliance
  • Payment Records: Retained for at least 7 years to comply with tax and financial regulations
  • Marketing Data: Retained until you opt-out or request deletion
  • Server Logs: Retained by our hosting provider for a short operational period (typically no more than 30 days) and then deleted
  • Support Communications: Retained for 3 years for quality assurance and dispute resolution

7.2 Deletion Requests

If you request deletion of your personal information, we will delete data that is not required for legal, regulatory, or legitimate business purposes.

8. International Data Transfers

FairFlow LLC is incorporated in the United States. Our service providers are located in both the United States and the European Union, so your personal information may be processed in either region depending on which provider handles it:

  • Website hosting and server logs: Vercel, a United States company. Static pages are delivered from a global content delivery network, so the server nearest you may be outside your country
  • Form submissions and follow-up communication: our workflow automation system at automation.evercompany.eu
  • Scheduling: Cal.com, via its European Union instance at app.cal.eu
  • Payments: Stripe, which operates internationally

Where personal data of individuals in the European Economic Area or the United Kingdom is transferred to the United States, we rely on the European Commission's Standard Contractual Clauses, or on another transfer mechanism permitted under Chapter V of the GDPR, as set out in our data processing agreement with the relevant provider.

You may request further information about the safeguards applied to a specific transfer by contacting us at the address in Section 11.

9. Children's Privacy

Our services are not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18.

If we become aware that we have collected personal information from a child under 18 without parental consent, we will take steps to delete that information as soon as possible.

If you believe we may have collected information from a child under 18, please contact us immediately at hello@myfairflow.com.

10. Changes to Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors.

When we make changes to this Privacy Policy, we will:

  • Update the "Last Updated" date at the top of this page
  • Post the revised Privacy Policy on our website
  • Notify you via email if the changes are material

We encourage you to review this Privacy Policy periodically. Your continued use of our services after changes are posted constitutes your acceptance of the updated Privacy Policy.
